Terms of Service

These Terms of Service ("Terms") govern your access to and use of Seedance, an AI video generation application and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Seedance lets you generate short videos using AI models: you provide text prompts and optional reference materials (images, video clips, audio), and the Service produces generated video content. Video generation is performed by third-party AI model providers and is subject to availability, queue times, and content-safety review.

2. Eligibility and Accounts

• You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service.
• You sign in via a supported third-party provider (Google, TikTok, or Apple). You are responsible for safeguarding access to your sign-in provider account.
• You are responsible for all activity that occurs under your account.
• You may delete your account at any time from within the App; see the Privacy Policy for what happens to your data.

3. Your Content and License

• Your inputs — you retain all rights you hold in the prompts and reference materials you upload. You represent and warrant that you own or have the necessary rights to the materials you upload, and that they do not infringe any third party's rights (including copyright, trademark, privacy, and publicity rights).
• Generated content — subject to these Terms and applicable law, we assign to you the rights we hold in the videos generated from your inputs. You are responsible for how you use generated content.
• License to us — you grant us a limited, worldwide, non-exclusive license to host, store, process, and transmit your inputs and generated content solely to operate, maintain, and improve the Service (e.g., sending inputs to the AI model provider, archiving results so you can replay them).

4. Acceptable Use

You agree NOT to use the Service to create, upload, or share content that:

• Is illegal, or promotes illegal activity
• Depicts or sexualizes minors in any way, or exploits or harms minors
• Is sexually explicit, or non-consensual intimate imagery of any person
• Impersonates a real person without consent, including deceptive "deepfakes" of identifiable individuals
• Harasses, threatens, defames, or incites violence or hatred against any person or group
• Infringes intellectual-property or other proprietary rights of others
• Spreads misinformation presented as fact with intent to deceive (e.g., fabricated events involving real people)
• Contains malware, or attempts to probe, disrupt, overload, or reverse-engineer the Service

5. AI-Generated Content Disclaimer

• Generated videos are produced by AI models and may be inaccurate, unexpected, or unsuitable for your purposes. We do not guarantee any particular quality, accuracy, or fitness of generated output.
• Similar or identical outputs may be generated for other users from similar inputs; we cannot guarantee uniqueness of generated content.
• You are solely responsible for reviewing generated content before using or sharing it, and for ensuring your use complies with applicable laws (including disclosure obligations for synthetic media where required).

6. Credits and Purchases

• Video generation may consume credits. Credit pricing and consumption rates are displayed in the App and may change with notice.
• Credits may be purchased via Apple In-App Purchase. All purchases are processed by Apple and are subject to Apple's payment terms; refunds for purchases are handled through Apple.
• Credits are consumed when a generation task is submitted. If a task fails or is cancelled before completion, the consumed credits for that task are automatically returned.
• Credits have no cash value, are non-transferable, and unused credits are forfeited upon account deletion or termination for violation of these Terms.

7. Intellectual Property of the Service

The Service itself — including the App, our software, design, and branding — is owned by us or our licensors and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.

8. Third-Party Services

The Service relies on third-party providers (AI model providers, sign-in providers, cloud storage, Apple). Their availability is outside our control, and your use of third-party services (e.g., Google or TikTok sign-in) is governed by their own terms and policies.

9. Suspension and Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if required by law. Where reasonable, we will notify you of the reason.
• Upon termination, sections that by their nature should survive (content responsibility, disclaimers, limitation of liability) will survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR REQUIREMENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

13. Changes to the Service and Terms

We may modify the Service or these Terms at any time. Material changes will be announced in the App; the "Last updated" date reflects the latest revision. Continued use after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law principles. Disputes shall first be attempted to be resolved through good-faith negotiation; failing that, they shall be submitted to the competent courts of that jurisdiction.
